These Terms & Conditions ("Terms") govern your access to and use of services provided by Big Water Cowboys, LLC, doing business as TowBoatU.S. Lake Texoma ("Company," "we," "us," or "our"), including marine towing, salvage, dispatch services, SMS communications, tracking tools, and digital platforms such as TIDE (Towing Invoice & Dispatch Engine).


1. Acceptance of Terms

By requesting services, accessing our website, or communicating with us, you agree to these Terms. If you do not agree, do not use our services.


2. Marine Towing & Assistance Services

TowBoatU.S. Lake Texoma provides marine towing and on-water assistance services. Response times and estimated arrival times (ETAs) depend on weather conditions, lake conditions, vessel location, emergency prioritization, and operational factors. We do not guarantee specific arrival times.

In emergencies involving immediate danger to life or property, call 911 or the appropriate emergency authority.


3. Salvage & Recovery Services

Salvage operations may involve elevated risk and specialized equipment. Charges may vary based on vessel size, degree of peril, time required, equipment deployed, and environmental risk. Formal salvage agreements may apply when required.


4. Payment Terms

Payment responsibility may include BoatUS membership coverage, insurance claims, or direct payment. Customers remain ultimately responsible for charges not covered by membership or insurance. Failure to remit payment may result in collection action or maritime lien rights where permitted by law.


5. SMS & Mobile Communications Program

TowBoatU.S. Lake Texoma operates an SMS/Text Message Program for dispatch and service communications.

Program Description: Messages may include dispatch confirmations, captain identification, ETA updates, tracking links, service completion notices, and feedback requests. Messages are transactional and related to customer-initiated service requests.

Message Frequency: Message frequency varies based on the nature of the service.

Message & Data Rates: Message and data rates may apply.

Opt-Out: Reply STOP to cancel messages. Reply HELP for assistance.

Carriers are not liable for delayed or undelivered messages.


6. Location & Tracking Services

We may provide live tracking tools (including third-party platforms such as i911.com). Location accuracy depends on GPS signal, cellular networks, device capabilities, and environmental conditions. We do not guarantee uninterrupted or perfectly accurate tracking.


7. Digital Platforms & Software (TIDE)

We may provide digital dispatch and communication systems, including TIDE. All software and related systems remain the intellectual property of the Company unless otherwise agreed in writing. We reserve the right to modify or discontinue digital features at any time without liability.


8. Website Use

You agree not to interfere with website security, attempt unauthorized access, or misuse website content. All website materials are the property of the Company and may not be reproduced without permission.


9. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, or punitive damages arising from service delays, weather conditions, tracking inaccuracies, communication interruptions, or operational limitations. Marine activities inherently involve risk.


10. Force Majeure

We are not liable for failure to perform due to events beyond our control, including severe weather, natural disasters, government action, or communication network failures.

12. Governing Law

These Terms are governed by the laws of the State of Texas. Venue for disputes shall be Grayson County, Texas.
